Abstract

Geographical indications are indications which identify a good as originating in the territory of a member, or a region or locality in that territory, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin . It is mainly used to identify agricultural, handicraft, manufacturing goods from a particular territory which has developed a good will in the market due to its special characteristics. The said characteristics include temperature, humidity, soil etc. Associated with territories that are unique. Since the qualities depend on the geographical place of production, there is a clear link between the product and its original place of production. Geographical indication is a valuable sagacity, a source identifier and indicator of quality, geographical indication helps to promote its goods “eligible for relief from acts of infringement and/ or unfair competition.” Protection of geographical indication prevents third parties from passing off their products as those originating in the given region. Traditional knowledge is tradition based literary, artistic or scientific works, performances, inventions, scientific discoveries, designs, marks names, and symbols; undisclosed information, and all other tradition based innovations and creations resulting from intellectual activity in the industrial, scientific, literary or artistic fields.
