INDIA AND THE CONVENTION ON SUPPLEMENTARY COMPENSATION FOR NUCLEAR DAMAGE, 1997

Abstract

Legal instruments are in place to herald an era of accelerated nuclear energy generation in India. This enables India to carry out trade of nuclear fuel and technologies with other countries within the stipulations placed by the Nuclear Suppliers Group, granting waiver to India by these nuclear supplier countries. Besides, there would be country specific agreements. To instill confidence among the suppliers of technology and materials, a Nuclear Liability Act has been put in place to limit their liability. Besides India has also signed the Convention on Supplementary Compensation to provide for additional resource for assistance seeking indemnification for loss and injury from a nuclear installation.

1. Convention of 31st Jan. 1963 Supplementary to the Paris Convention of 1960 as amended by the additional Protocol of 1964 and by the Protocol of 1982. (Brussels Supplementary Convention, 1963). 
2. Convention on Supplementary Compensation for Nuclear Damage, adopted on 12th Sept. 1997. Not yet in force. 
3. Convention on Third Party Liability in the Field of Nuclear Energy of 29 July 1960, as amended by the Protocol of 1964 and by the Protocol of 1982. (Paris Convention, 1960) 
4. Joint Protocol on the Application of the Vienna Convention and the Paris Convention. (Adopted on 21 September 1988, entered into force in 1992). 
5. The Protocol of 2004 amending Convention of 31st Jan. 1963 Supplementary to the Paris Convention of 1960 as amended by the additional Protocol of 1964 and by the Protocol of 1982. 
6. The Protocol of 12th Feb. 2004 amending Convention on Third Party Liability in the Field of Nuclear Energy of 29 July 1960, as amended by the Protocol of 1964 and by the Protocol of 1982. 
7. The Protocol of 1997 amending the 1963 Vienna Convention. (Vienna Convention Protocol) 
8. Vienna Convention on Civil Liability for Nuclear Damage, adopted on 21 May 1963. Entered int0 force on 12 Nov. 1977.
