MANAGERIAL AND LEGAL PERSPECTIVE OF FDI IN RETAIL IN INDIA

Abstract

FDI is a category of cross border investment made by a resident in one economy (the direct investor) with the objective of establishing a ‘lasting interest’ in an enterprise. Term ‘retail’ is a sale for final consumption in contrast to a sale for further sale or processing. The retail industry is divided into organised and unorganised sectors. Organised retailing refers to trading activities undertaken by licensed retailers, that is, those who are registered for sales tax, income tax, etc. An Indian company may receive Foreign Direct Investment under the Automatic Route and Government Route. Subject to the FDI Policy, except for Pakistan all non-resident entity can invest in India. A citizen or an entity incorporated in Bangladesh can invest in India, only under the Government route. It is the intent and objective of the Government of India to attract and promote foreign direct investment in order to supplement domestic capital, technology and skills, for accelerated economic growth.
